These Terms of Service ("Terms") govern your access to and use of our website, bouquet ordering, subscription services, and delivery services (collectively, the "Services"). By using our Services, you agree to these Terms. Please read them carefully.
1.1 Eligibility: By using our Services, you confirm that you are at least 18 years old or have the consent of a parent or guardian.
1.2 Changes to Terms: We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the Services constitutes acceptance of the revised Terms.
Each floral arrangement will vary based on seasonality and availability. Depending on which tier you select, the arrangement may differ. We strive to provide the best quality and variety possible within the constraints of seasonal availability.
3.1 Ordering: You can order individual bouquets or subscribe to our bouquet subscription service through our website. All orders are subject to availability.
3.2 Subscription Plans: We offer various subscription plans, including weekly, bi-weekly, and monthly delivery options. Details, including pricing, are available on our website.
3.3 Billing: Subscription fees are billed automatically based on the plan you choose. By subscribing, you authorize us to charge your payment method for the subscription fee and any applicable taxes.
3.4 Modifications and Cancellations: You may modify your subscription plan or cancel it at any time through your account on the Stripe website here. Modifications or cancellations must be made at least 7 days before your next scheduled delivery to avoid being charged for that delivery.
4.1 Delivery Area: We deliver bouquets within the Denver metropolitan area. Orders outside this area may incur additional charges or may not be fulfilled.
4.2 Delivery Schedule: Deliveries occur every Tuesday and Thursday, however these specific days are not guaranteed. If these days are inconvenient, please contact us via email to arrange an alternative. We will inform you via email if a different delivery schedule is necessary.
4.3 Delivery Issues: We will attempt to deliver flowers directly to the recipient. If the recipient is unavailable, the arrangement will be left outside. Elizabeth Rose Florals is not responsible for damage due to weather or other conditions after delivery. We will use all available measures to protect the flowers and inform you of any issues encountered.
4.4 Special Instructions: If you have any specific delivery instructions, please provide them at the time of placing your order. We will do our best to accommodate your requests.
5.1 Satisfaction Guarantee: At Elizabeth Rose Florals, we take pride in the quality of our flowers. If you are not satisfied with your bouquet, please contact us within 24 hours of delivery. We will work with you to provide a suitable replacement or credit.
5.2 Non-Returnable Items: Due to the perishable nature of flowers, we do not accept returns. However, we are committed to ensuring your satisfaction and will address any issues promptly.
6.1 Payment Methods: We accept various payment methods, including credit cards and PayPal, as listed on our website. All payments are processed securely.
6.2 Taxes: Applicable sales taxes will be added to your order total, where required by law.
6.3 Payment Disputes: If you believe there is an error in your billing, please contact us immediately. We will review and, if necessary, correct the charge.
Elizabeth Rose Florals is not responsible for any external or internal effects of flowers, foliage, or other materials on persons, clothing, or any other materials before, at, or after delivery.
By accepting our services, you consent to being added to the Elizabeth Rose Florals email distribution list. You can request removal or a change to a different email address at any time.
Elizabeth Rose Florals may use images of the Client’s service for promotion, display, advertising, internet, and publication unless there is a specific written request to the contrary.
If you have any flowers or materials you would like to exclude, please indicate them in the "anything else we should know" box. We will do our best to accommodate your preferences.
The rental period will be mutually agreed upon by Elizabeth Rose Florals and the client in writing. Elizabeth Rose Florals will provide the client with pricing for rental items. An order link will be sent to the client, and payment is required upon receipt of this link. Elizabeth Rose Florals reserves the right to cancel any events that do not adhere to the payment deadlines.
During the mutually agreed upon pickup or delivery date, both the client and Elizabeth Rose Florals will inspect, referred to as "the inspection", each rental item for quality. The client must notify Elizabeth Rose Florals, both verbally and in writing, of any damages at this time. The client must also send a photo of any damaged item to Elizabeth Rose Florals at elizabeth@elizabethroseflorals.com. If no email is sent during the inspection, the client will assume responsibility for any damages incurred afterward. At the time of return or drop-off, the client will again notify Elizabeth Rose Florals, both verbally and in writing, of any damages. The client must provide a photo of the damage to Elizabeth Rose Florals during the return inspection. Elizabeth Rose Florals reserves the right to charge the client for any damages or losses that were not reported. Elizabeth Rose Florals will provide a photo to the Client of the unreported damage to the client upon request.
The client agrees to pay the full replacement costs for any lost or damaged items rented from Elizabeth Rose Florals, and these payments must be made through Stripe or Intuit QuickBooks within one day of receiving the invoice.
12.1 Personal Information: We collect and use your personal information in accordance with our Privacy Policy. By using our Services, you consent to such collection and use.
12.2 Data Security: We take reasonable measures to protect your personal information from unauthorized access or disclosure. However, we cannot guarantee absolute security.
13.1 Ownership: All content on our website, including text, images, and logos, is the property of Elizabeth Rose Florals or its content suppliers and is protected by copyright and other intellectual property laws.
13.2 Use of Content: You may not use any content from our website without our express written permission.
14.1 No Warranty: Our Services are provided "as is" without any warranties, express or implied. We do not guarantee that the Services will be uninterrupted or error-free.
14.2 Liability: To the fullest extent permitted by law, Elizabeth Rose Florals shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.
15.1 Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.
15.2 Dispute Resolution: Any disputes arising from these Terms or your use of the Services shall be brought in Small Claims Court. Before any claim is brought in any other court or forum the parties agree to participate in at least four hours of mediation with a member of the Mediation Association of Colorado. In the event of further litigation, Elizabeth Rose Florals is entitled to recover its reasonable attorneys’ fees and costs should they prevail in whole or in part.
